Here are the performance benchmarks that the NELHA boar approved as conditions of a lease between NELHA and Megasoft. Although the action was mooted by the failure to give full public notice of the meeting, it is likely that the same conditions will be presented at the next NELHA board meeting.
- Megasoft will immediately execute a NELHA lease upon approval of said lease by the NELHA board.
- Megasoft will immediately begin lease payments per the lease.
- Megasoft will tender the first and last months’ rental payments at the time of lease execution.
- Megasoft will, within one month from the date of the lease, engage a data center design contractor and a general contractor for construction of the building itself.
- Within that same month, Megasoft will begin the process with HELCO to obtain operating power to the site and building.*
- Within three months, Megasoft will file with the County of Hawaii for the necessary permits to allow construction.*
- Within eight months, grading of the site will be completed and utilities will be roughed in.
- Megasoft will begin construction of the building within one year.
- Operation of the center will begin 18 months from the date of executing the lease.
*These are milestones recognized as highly dependent on the actions of others, specifically HELCO and the County of Hawai`i. To the extent these organizations create or contribute to delays in executing the next milestone, Megasoft asks that time be extended accordingly.
Megasoft will keep NELHA apprised of our progress on each of these milestones. If the milestones are not completed in a timely fashion (except to the extent they are delayed due to outside influences, such as delays in receiving permits, strikes, etc.), then Megasoft agrees to cancellation of its lease.
