The U.S. Supreme Court will not be hearing an appeal from a Maui landowner wanting to build a house on an oceanfront parcel in Makena. On January 14, the court denied cert to Douglas Leone and his wife, Patricia Perkins-Leone.
The Leones had lost their case in the state Supreme Court in October 2017. (For details, see our article in the November 2017 issue.)
Backing their appeal to the Supremes were some heavyweight conservative champions, including the Pacific Legal Foundation, the Cato Institute, the U.S. Chamber of Commerce, and – not least, University of Hawai`i law professor David Callies.
The high court does not provide any reason for its decisions on granting certiorari.
