The Environmental Protection Agency’s administrator, Lisa P. Jackson, is being sued by opponents of the Hu Honua power plant. The plant, in Pepe’ekeo, is being built on the site of a sugar mill. Its operators say they will use only biomass as fuel for the plant, designed to produce 24 megawatts of electricity.

Preserve Pepe’ekeo Health and Environment, an unincorporated association consisting mostly of people who have homes nearby, filed a lawsuit in federal district court in Honolulu on September 19. The complaint seeks an order requiring Jackson to make a decision on a petition PPHE filed in August 2011 challenging the Hu Honua permit.

That petition alleges that the state Department of Health violated the federal Clean Air Act in granting a permit to operate to Hu Honua. Among other things, the group alleges that the permit does not comply with the requirements that it prevent significant deterioration of air quality, that it limit emissions of hazardous pollutants, and that it achieve employ maximum achievable control technology.
